PRACTICE AREAS

Commercial Law

Technology and Intangible Assets including IP oriented agreements are my specialisation.  I've seen every trick in the book - drafters of these agreements oftentimes contort and hide terms - I have a keen eye to spot these attempts to take more than negotiated.  Instead, my approach is to use plain English and clearly define what is given and what is taken.  I do not want my clients to buy a lawsuit.  I want them to go forward, gain what they need and want, and get on with business.

Strategy

Intangible Assets include IP.  There are so many ways that a business can benefit from identifying what it actually owns by way of an audit - especially when anticipating a merger or acquisition.  Apart from the obvious IP assets normally front of mind like patents and trade marks, there may be a pot of gold in your business when it comes to intangible assets like copyrights, trade dress (get up),  goodwill, confidential information (such as data) and know-how.  It is worth itemising these assets to add book value to your business.  For example, Google booked its goodwill value at $29B in 2023.

Strategy further includes landscape (Freedom-to-Operate) analyses - by combing public databases learning the directions in which your competitors are moving with their innovations, a common practice among IP savvy companies.

Strategy also includes managing your own innovation with innovation tools.

Strategy involves building portfolios of registered IP rights.
